Ways of Working
The following explains some limitations, commitments and expectations that apply when we work with you. This is in addition to any contract that is agreed between us. Further information is contained in the applicable Scheme Rules, which also apply.
1.1 Where the customer implements any advice or opinion given by NCB, the customer is solely responsible for the method and manner of implementing such advice or opinion and for the outcome of such implementation. NCB shall have no liability to the customer in respect of the implementation, or the outcome of implementing, any advice given by NCB.
1.2 NCB will only grant certification when the customer has demonstrated compliance with all applicable requirements.
1.3 NCB may at any time make changes to the certification requirements which are necessary to comply with any applicable safety or other statutory requirements, or which are necessary to comply with the relevant standards or which are necessary to meet the requirements of the relevant accreditation authority and the customer shall comply with such changes as soon as reasonably practicable after notification of such changes.
1.4 NCB reserves the right in its sole judgement to change or revise the application of the requirements in the respective service standards, criteria, methods or procedures, however, reasonable notice will be given to the customer such that continued conformance with NCB’s requirements is practicable.
1.5 NCB may require access for observers from relevant interested parties including accreditation bodies, contracted testing and inspection personnel, and regulators. NCB will inform the customer in advance if this access is required. The customer shall make all necessary arrangements to enable this access to be provided
1.6 The customer:
1.6.1. shall at their own expense, supply NCB in a timely manner with copies of all documents, materials, information, data and samples necessary to perform the services, translated into English if necessary. NCB shall have no liability for any loss or damage to such documentation, however caused
1.6.2. shall ensure that such data and information as is required under this clause is accurate in all material respects, is materially complete and is provided to NCB earlier or by the date specified in the relevant milestones.
1.6.3. shall notify NCB of any changes to its contact details or legal entity status, including ownership, within 7 days of the change. Certification is only transferrable with the written agreement of NCB.
1.6.4. shall inform the certification body, without delay, of changes that may affect its ability to conform with the certification requirements
1.6.5. must always fulfil the certification requirements including implementing appropriate changes when they are communicated by the certification body.
1.6.6. shall not use its certification in such a manner as to bring the certification body into disrepute and does not make any statement regarding its certification that the certification body may consider misleading or unauthorized; in making reference to its certification in communication media such as documents, brochures or advertising, the customer shall comply with the requirements of the certification body or as specified by the appropriate certification scheme
1.6.7. if provision of copies of the certification documents to others is required, shall reproduce the provided by NCB documents in their entirety or as specified in the certification scheme
1.6.8. shall not, without NCB’s written permission, alter, modify, deface or destroy a certificate.
1.6.9. unless required by law, or with NCB’s written permission, shall not reproduce or distribute any report to any external third party and when permitted only in its entirety and without any change, deletion or addition to it
1.6.10. shall notify NCB immediately if it becomes aware of any unauthorised use of the whole or any part of a related report
1.6.11. may publicise the fact that certification has been granted and use the certificate as evidence of certification. The customer may copy the certificate, provided that each copy is clearly identified as a “copy”. The original and any copies of the certificate remain the property of NCB and must be returned immediately if requested by NCB.
1.6.12. shall be responsible for any delays resulting from any material, products, documentation and/or instructions supplied by the customer which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form or arising from their late arrival or non-arrival or any fault of the customer that results in significant delays to other projects. The customer shall be responsible for all reasonable costs, charges or losses sustained by NCB by reason of such delays.
1.6.13. shall provide NCB and/or any representative of NCB with reasonable access to the customer’s facilities, personnel and records to enable NCB to conduct an assessment of the customer’s compliance with their applicable obligations.
